A Hove man has been cleared of shouting racist abuse at shop staff at 4am on a Sunday morning almost a year ago.
The case against George Dalmon, 28, of Lansdowne Street, Hove, was thrown out by the bench at Brighton Magistrates’ Court last Friday (13 March).
He had been accused of being abusive to Asian staff at the Subway branch in Church Road, Hove, in the small hours of Sunday 30 March last year.
The charge said that he “used threatening or abusive words or behaviour or disorderly behaviour within the hearing or sight of a person likely to be caused harassment, alarm or distress, thereby, and the offence was racially aggravated”.
A second charge – of using threatening, abusive or insulting words or behaviour with intent to cause PC Henry Cox to believe that immediate unlawful violence would be used against him – was also dismissed after the Crown Prosecution Service offered no evidence.
The magistrates awarded costs in the case to Mr Dalmon, to be paid from central funds.
